The Department of Veterans Affairs has removed a bureaucratic hurdle for veterans pursuing private medical care. In a significant policy change, referrals issued by VA doctors for community care will now bypass the need for a secondary review by an additional VA clinician or administrator, effective immediately.
The recent change results from the implementation of the Senator Elizabeth Dole 21st Century Veterans Healthcare and Benefits Improvement Act, which was signed into law in December by former President Joe Biden. The law explicitly forbids VA administrators from overruling a physician's referral for outside care, a measure that veterans’ advocates have consistently condemned as an obstacle to prompt treatment.
On Monday, VA Secretary Doug Collins announced, “Now, we’re making it even easier for veterans to access their health care when and where it’s most convenient for them.” “Our focus is on enhancing customer service and ensuring convenience.”
In the past, referrals for private care under the VA MISSION Act required navigating an internal administrative process. Critics, including numerous Republican lawmakers, contended that this practice dissuaded the utilization of community care. In contrast, Democrats defended it, asserting it as essential oversight.
A new rule will be implemented for two years, during which time the VA is required to provide a report on its effects to Congress.
The reform is introduced in response to persistent issues surrounding delays and obstacles in accessing mental health treatment. Lawmakers have brought attention to instances in which veterans faced delays in accessing essential residential rehabilitation programs, despite their pressing needs.
In a continuing discussion on oversight priorities, Rep. Mariannette Miller-Meeks, R-Iowa, and Rep. Julia Brownley, D-Calif., have expressed differing views. However, both lawmakers concur on the urgent need for improved access to essential services for veterans.
The VA has announced that it has initiated staff training to facilitate implementing the updated referral process in line with the Dole Act.
